This is a communication from a debt collector. This is an attempt to collect a debt and any information obtained will be used for that purpose.
For residents of Hawaii and Vermont, this is an attempt to collect a claim and any information obtained will be used for that purpose.
OPTIONAL PROVISION: Apex Asset Management, LLC is a licensed collection agency. For purposes of this agreement and text message communications we will always refer to our company as APEX.
By subscribing to Apex Asset Management, LLC’s Text Message Service you agree to the following Terms and Conditions:
Mobile Phone Ownership and Mobile Number: When you subscribe to Apex Asset Management, LLC’s text message service you are confirming the mobile phone number you use to subscribe is the mobile number associated with your mobile phone. You and no other person will use this mobile phone to communicate with Apex Asset Management, LLC about your account(s). Throughout this agreement the word “you” includes the person associated with the mobile phone and mobile number you use to subscribe to this text message service.
Agreement: This Terms and Conditions document is an agreement between you and Apex Asset Management, LLC which explains some of your important rights under the law, how the text message service works, how text fees and data rates may apply, how you may access information, when we may initiate text messages to the mobile phone number you used to subscribe, your agreement to receive text messages and other important features associated with the text message service. To agree to these Terms and Conditions choose Text as Your communication preference from the Payment Portal and respond to the text received from Apex Asset Management, LLC to verify your account.
If you delete your text messaging history from your mobile phone you may lose information about this text message service. To retrieve the Terms and Conditions you can go to evokepay.com/apx/login.
Voluntary Participation: Apex Asset Management, LLC is a third-party debt collector and offers this text message service to you in connection with the collection of debt. This is a voluntary service you may start or stop at any time.
Purpose: The purpose of this text message service is to allow you to obtain information about your account(s) associated with this mobile phone number by communicating via text with Apex Asset Management, LLC.
Accounts: This text message service allows you and this Apex Asset Management, LLC to communicate about any accounts associated with the mobile phone number you provide when selecting to communicate via text message. Accounts placed with us for collection by more than one business may be excluded from this text message service and Accounts placed with us that are closed, inactive, subject to a cease communication, communication restrictions or otherwise prohibited from collection activity will be excluded from this text message service.
Communication Agreement: By agreeing to the Communication Agreement in the Payment Portal, you consent to the terms as presented and further agree:
- Apex Asset Management, LLC may send limited types of text messages to you about Account(s);
- You may obtain additional information about your Account(s) by visiting Apex Asset Management, LLC’s Payment Portal at evokepay.com/apx/login;
- When you interact with the Payment Portal, you may receive an immediate, automated response from Apex Asset Management, LLC regardless of the time of day, day of week or frequency of the communications; and
- Text messages sent to you by Apex Asset Management, LLC may appear on the face of your mobile phone or device and you will manage the settings associated with how text messages are displayed on your phone or device to protect your confidential information.
Text Message Service Termination Process: To terminate participation or unsubscribe from Apex Asset Management, LLC’s text message service, you need to text the word ALTO, STOP, STOP!, STOPNOW, STOPALL, END, QUIT, QUITNOW, CANCEL, CANCELAR, NOMO, UNSUBSCRIBE, REMOVE, OPTOUT, PARA, PARAR, PARE, or ARRET to Apex Asset Management, LLC’s text number. You may also unsubscribe by visiting the Payment Portal at evokepay.com/apx/login and deselecting text as a Communication Preference.

- Apex Asset Management, LLC Initiated Text Message Service – Apex Asset Management, LLC may at times decide to initiate text messages to the mobile phone number you use to subscribe to its text message service.
- Account Verification – Apex Asset Management, LLC may send you a text message after you enter your email address or phone number in the communication preferences on the Apex Asset Management, LLC Payment Portal. You must click the link to verify your account and receive future notifications.
- Broken Promise – Apex Asset Management, LLC may send you a text message to follow up on an Account where a payment was missed. (Same as Generic Past Due)
- Debt Verification Request – Apex Asset Management, LLC may send you a text message to respond to your request for your Debt Verification Information.
- Declined Payment – Apex Asset Management, LLC may send you a text message based on your Communication Preferences when your payment is declined. (Same as Errored Payment & Failed Payment)
- EFT Notification Letter – Apex Asset Management, LLC may send you a text message to provide you access to your Funds Transfer Notification.
- Electronic Payment Reminder – Apex Asset Management, LLC may send you a text message reminder to notify you of the amount and the date when your authorized electronic payment will be processed. (Same as Scheduled Payment Reminder)
- Errored Payment – Apex Asset Management, LLC may send you a text message based on your Communication Preferences when your payment has errored. (Same as Declined Payment & Failed Payment)
- E-Statement/Document Notification – Apex Asset Management, LLC may send you a text message when you have opted in for electronic delivery of documents and a new document has been generated for your account.
- E-Statement/Document Enrollment Confirmation – Apex Asset Management, LLC may send you a text message to confirm you have opted in for electronic delivery of your documents.
- E-Statement/Document Unenrollment Confirmation – Apex Asset Management, LLC may send you a text message to confirm that you have opted out of electronic delivery of your documents.
- E-Statement/Document Reminder – Apex Asset Management, LLC may send you a text message to remind you to view an existing document which has not yet been viewed.
- Expired Credit Card – Apex Asset Management, LLC may send you a text message when you have a credit card associated with a payment arrangement and the credit card has expired. The notification is sent on the first day of the month that the card expired.
- Expiring Credit Card – Apex Asset Management, LLC may send you a text message when you have a credit card associated with a payment arrangement and the credit card is about to expire. The notification is sent on the first day of the last month that the card is valid.
- Failed Payment Notification – Apex Asset Management, LLC may send you a text message if your payment did not process due to insufficient funds in the account or another problem which prevented the processing of the payment. (Same as Declined Payment & Errored Payment)
- Generic Past Due – Apex Asset Management, LLC may send you a text message to follow up on an Account where a scheduled payment was missed. (Same as Broken Promise)
- Inactive E-Statement/Document Opt Out – Apex Asset Management, LLC may send you a text message to inform you that due to inactivity in viewing documents, the system will automatically set you back to receiving documents via paper delivery.
- Initial Communication – Apex Asset Management, LLC may send you a text message to inform you that a they have received your Account for collection.
- Initial Communication – Validation Information - Apex Asset Management, LLC may send you a text message with access to your Validation Information and inform you that they have received your Account for collection.
- Name of Original Creditor – Apex Asset Management, LLC may send you a text message to respond to your request for the Name of the Original Creditor.
- New Account Notification – Apex Asset Management, LLC may send you a text message to let you know that we have received a new account for you.
- Payment Plan Cancelled – Apex Asset Management, LLC may send you a text message when your payment plan has been cancelled.
- Payment Plan Completed – Apex Asset Management, LLC may send you a text message when the last payment in your payment plan has processed and completes the plan.

- Scheduled Payment Processed – Apex Asset Management, LLC may send you a text message when a scheduled payment is processed successfully.
- Scheduled Payment Confirmation – Apex Asset Management, LLC may send you a text message to confirm that a payment has been scheduled for a future date.
- Scheduled Payment Reminder – Same as Electronic Payment Reminder.
- Validation Notice – Apex Asset Management, LLC may send you a text message to provide you access to your Validation Information.
- Void Confirmation – Apex Asset Management, LLC may send you a text message when you made a payment online or over the phone but then had that payment voided by an agent at the company.
Costs and Charges: Apex Asset Management, LLC does not have a separate charge for this text message service; however, message and data rates may apply from your mobile phone carrier. Subject to the terms and conditions of your mobile phone carrier, you may receive text messages sent to your mobile phone. Participation in this text message service is standard rated (no premium content).
By providing your consent to participate in this text message service, you approve any such charges from your mobile phone carrier. Charges for text messages may appear on your mobile phone bill or be deducted from your prepaid balance.
